A Judge Says xAI's Turbines Are Not Mobile: The Colossus Clean Air Case Moves Forward

A federal judge has refused to throw out the NAACP's Clean Air Act lawsuit over the gas turbines powering xAI's Colossus data center complex outside Memphis. In a 28-page opinion signed on Friday, October 30, U.S. District Judge Debra M. Brown denied xAI's motion to dismiss, ruling that the plaintiffs have standing, that the turbines are not mobile sources under Mississippi's federally approved clean air plan, and that the Clean Air Act's citizen suit provision does not violate the Constitution. The claims, in her words, will proceed.

OpenAI Cuts Its Funding Target to 20 Billion Dollars After a Tepid Response From Big Investors

OpenAI's latest funding round is not landing the way the last ones did. The Financial Times reported on Friday that the company has lowered its target to 20 billion dollars, with a first close expected to come in lower still, and The Wall Street Journal added that OpenAI has so far secured roughly 11 billion dollars in commitments after a tepid response from some large investors. That is less than half of the 30 billion dollars the company initially targeted, and the deal now values OpenAI at 1.25 trillion dollars rather than the 1.4 trillion it had hoped for.

Nvidia May Co-Sign the Data Center: Chip Supplier, Investor, Now Debt Backstop

Nvidia is in talks to guarantee billions of dollars in debt financing for Nscale's planned Anthropic data center in West Virginia, The Information reported on Thursday, in a story TechCrunch published late on October 30 and Bloomberg corroborated. Anthropic has signed a 44.6 billion dollar contract for the project's first building alone, according to Nscale's IPO filing. In plain terms, the chipmaker would be co-signing a customer's loans, a sign of how hard the industry is working to keep its buildout afloat as investors grow jittery about the sums involved.
